Eine solche Ma\u200e\u00dfnahme wurde vor dem Hintergrund der autorit\u00e4ren Vorgehensweise der konservativen ungarischen und polnischen Regierung eindringlich verlangt. Doch auch die Regierung und die Mehrheit in Bukarest wurden zum Ziel scharfer Kritik der europ\u00e4ischen Institutionen und der Mehrheit der Europaabgeordneten &#8211; sie sehen Teile der \u00c4nderungen am Justiz- und Strafrecht als Abweichungen von der Rechtsstaatlichkeit. Auch die Versuche, einen Wechsel an der Spitze  der Staatsanwaltschaften durchzusetzen und das unverh\u00e4ltnism\u00e4\u200e\u00dfige Eingreifen der Polizei bei der gro\u200e\u00dfen Protestkundgebung gegen die Regierung im August gelten in Br\u00fcssel als umstritten.<\/span><\/span><\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p dir=ltr style=line-height:1.38;margin-top:0pt;margin-bottom:0pt;>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p dir=ltr style=line-height:1.38;margin-top:0pt;margin-bottom:0pt;><span id=docs-internal-guid-50be25fc-7fff-1e03-5961-d8ed5ee4c241><span style=font-size: 11pt; font-family: Arial; color: rgb(0, 0, 0); background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;>Der Verordnungsvorschlag gilt f\u00fcr alle Mitgliedstaaten. Demnach soll die Europ\u00e4ische Kommission gemeinsam mit einem unabh\u00e4ngigen Expertengremium feststellen, ob ein Mitgliedstaat die Rechtsstaatlichkeit gef\u00e4hrdet, indem er ins Gerichtswesen interveniert oder  Ma\u200e\u00dfnahmen gegen Betrug und Korruption unterl\u00e4sst. Die Kommission wird dann Strafma\u200e\u00dfnahmen vorschlagen, je nach Schwere der Verst\u00f6\u200e\u00dfe gegen die Rechtsstaatlichkeit &#8211; vorstellbar sind entweder die K\u00fcrzung oder das Einfrieren von Zahlungen der Europ\u00e4ischen Union an diesen Mitgliedstaat. Die Entscheidung muss vom Parlament und vom Ministerrat genehmigt werden. Das betreffende Land ist verpflichtet, die Zahlungen an die Empf\u00e4nger der europ\u00e4ischen Fonds aus seinem Staatshaushalt fortzusetzen, wenn das Geld der Union gesperrt ist.<\/span><\/span><\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p dir=ltr style=line-height:1.38;margin-top:0pt;margin-bottom:0pt;>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p dir=ltr style=line-height:1.38;margin-top:0pt;margin-bottom:0pt;><span id=docs-internal-guid-50be25fc-7fff-1e03-5961-d8ed5ee4c241><span style=font-size: 11pt; font-family: Arial; color: rgb(0, 0, 0); background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;>Der rum\u00e4nische Europaabgeordnete Marian-Jean Marinescu hat f\u00fcr den Vorschlag gestimmt, sagt jedoch, dass er verbessert werden muss: <\/span><span style=font-size: 11pt; font-family: Arial; color: rgb(0, 0, 0); background-color: transparent; font-weight: 700; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;>&#8222;Es ist schwer f\u00fcr eine Ma\u200e\u00dfnahme zu stimmen, die Auswirkungen auf das eigene Land haben k\u00f6nnte. Gleichzeitig muss man sich jedoch an einige Grunds\u00e4tze halten. Es ist offensichtlich, dass der Umgang mit  europ\u00e4ischem Geld unbedingt alle Regeln einhalten muss, und wenn Schw\u00e4chen in der Rechtsstaatlichkeit bestehen, kann dies nat\u00fcrlich auch Auswirkungen auf den Haushalt haben. Und deshalb denke ich, dass am Ende eine solche Regelung existieren muss, aber sie muss verbessert werden, also in der Form angepasst werden. Wie \u00fcberall muss zwischen Strafe und Tat eine Verh\u00e4ltnism\u00e4\u200e\u00dfigkeit bestehen,&#8220;<\/span><span style=font-size: 11pt; font-family: Arial; color: rgb(0, 0, 0); background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;> sagt der Politiker.<\/span><\/span><\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p dir=ltr style=line-height:1.38;margin-top:0pt;margin-bottom:0pt;>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p dir=ltr style=line-height:1.38;margin-top:0pt;margin-bottom:0pt;><span id=docs-internal-guid-50be25fc-7fff-1e03-5961-d8ed5ee4c241><span style=font-size: 11pt; font-family: Arial; color: rgb(0, 0, 0); background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;>Die ALDE-Abgeordnete Norica Nicolai lehnte den Vorschlag ab: <\/span><span style=font-size: 11pt; font-family: Arial; color: rgb(0, 0, 0); background-color: transparent; font-weight: 700; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;>&#8222;Bei der gro\u200e\u00dfen Mehrheit der neuen Mitglieder, aber auch bei Spanien, Portugal und Italien besteht die Bef\u00fcrchtung, dass sie aufgrund des Vorgehens ihrer Regierungen einer willk\u00fcrlichen Ma\u200e\u00dfnahme der Kommission unterworfen werden &#8211; also der Aussetzung von Zahlungen. Es ist inakzeptabel, einen normativen Akt aufzustellen, der keine objektiven Kriterien f\u00fcr die Wertsch\u00e4tzung auferlegt und einige Beamte der Europ\u00e4ischen Kommission damit beauftragt, die Situation eines Versto\u200e\u00dfes gegen die Rechtsstaatlichkeit ohne Definition und ohne Kriterien zu pr\u00fcfen,&#8220;<\/span><span style=font-size: 11pt; font-family: Arial; color: rgb(0, 0, 0); background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;> kritisierte Nicolai. <\/span><\/span><\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p dir=ltr style=line-height:1.38;margin-top:0pt;margin-bottom:0pt;>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p dir=ltr style=line-height:1.38;margin-top:0pt;margin-bottom:0pt;><span id=docs-internal-guid-50be25fc-7fff-1e03-5961-d8ed5ee4c241><span style=font-size: 11pt; font-family: Arial; color: rgb(0, 0, 0); background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;>Der Weg bis zur Annahme ist kompliziert, die Vorschrift muss von den Staats- und Regierungschefs einstimmig angenommen werden.
